Federal regulators side with Arkansas on Entergy power contracts Thursday, Jul 7, 2005 Arkansas News Bureau LITTLE ROCK - A federal regulatory judge sided with the Arkansas Public Service Commission in a dispute with Louisiana regulators over power contracts filed by Entergy Corp. last month, PSC officials said Wednesday. Regulators in Arkansas and Louisiana had asked the Federal Energy Regulatory Commission to reconsider a recent ruling that denied a refund and rate reduction worth hundreds of millions of dollars for Louisiana utility customers. The power contracts, which allocate power from Entergy's wholesale operations to its retail sites in Louisiana, will reduce cost disparities among Entergy operating companies, Arkansas officials said. The reduction in costs diminishes the likelihood that Arkansas ratepayers will be required to pay for millions of dollars in production costs adopted by FERC on June 1. FERC Administrative Law Judge Lawrence Brenner approved the power contracts and ruled in favor of all the PSC's positions on issues affecting Arkansas ratepayers. Brenner rejected arguments by the Louisiana Public Service Commission, which said that benefits of the contracts should be assigned entirely to Entergy ratepayers in Louisiana and Texas. "(We) are please with Judge Brenner's decision and will not be appealing any of his rulings," the PSC said in a statement. |
