Court affirms decision favoring Volvo

LITTLE ROCK - The state Court of Appeals rejected a Little Rock trucking company's arguments Wednesday against a verdict favoring Volvo in its $80 million lawsuit against the Swedish automaker.

The appeals court concluded there was enough evidence to support the jury's verdict and rejected Pro Transportation Inc.'s argument that the circuit judge erred in dismissing a motion for a new trial and excluding evidence.

"None of Pro's points have merit," the court said.

The company alleged in its lawsuit that Volvo had committed fraud by selling the company trucks with inferior engines. Volvo countered that poor maintenance of the engines by Pro Transportation caused the problems.

A Pulaski County jury deliberated less than an hour before finding for Volvo.

Chief Judge John Mauzy Pittman, who wrote Wednesday's appeals court ruling, said there was evidence that "Pro was using synthetic motor oil in its trucks and sometimes went 75,000 miles or more between oil changes despite the recommendation of Volvo engineers that synthetic oils be changed every 25,000 miles."
