Forrest City lawyer cautioned Friday, Jun 20, 2008 Arkansas News Bureau LITTLE ROCK - Forrest City lawyer and former state Sen. Alvin Simes has been fined $500 and cautioned in connection with his handling of an appeal in a personal injury lawsuit. The Arkansas Supreme Court Committee on Professional Conduct found that Simes did not file documents in a timely manner on behalf of his client, Mattie Allison. A suit filed by Allison against State Farm Insurance was dismissed in Lee County Circuit Court in September 2006. Simes filed a notice of appeal in October 2006, according to the committee's findings. Simes did not file a record of the circuit court's proceedings with the clerk of the state Supreme Court within 90 days of filing the notice of appeal, the committee found. The appeal was dismissed in September 2007. The committee also ordered Simes to pay $50 to cover its costs. Simes was elected to a four-year term in the state Senate in 2000, but ended up serving just two years. Senators drew lots following the census that year to determine which lawmakers would have to run in newly redrawn districts in 2002. Simes was one of them, and he lost to Steve Higginbothom of Marianna. In 2006, Simes, a Democrat, finished last in a three-way Democratic primary race to succeed Higginbothom, who did not seek re-election. |
